Agreement to Terms

By downloading, installing, or using the ExpireMe™ mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legal agreement between you and Poker Games Interactive LLC ("PGI," "we," "us," or "our"). Please read these Terms carefully before using the App.

1. Description of Service

ExpireMe™ is a mobile application that helps you track expiration dates for various items including food, medicine, documents, credit cards, licenses, vehicle registration, insurance, coupons, and parking. The App provides the following features:

• Camera-based scanning and image recognition to identify expiration dates
• Local storage of expiration items and associated photos
• Notification reminders for expiring items
• Location-based reminders when you arrive at pinned grocery stores
• Map-based store search and display using Apple's MapKit service
• Interactive maps showing pinned store locations
• Biometric authentication (Face ID, Touch ID) for secure access
• Multi-category tracking and organization

2. Eligibility and Age Requirements

You must be at least 13 years of age to use ExpireMe™. If you are under 18, you represent that you have obtained parental or guardian consent to use the App. By using the App, you represent and warrant that:

• You are at least 13 years old
• You have the legal capacity to enter into these Terms
• You will use the App only for personal, non-commercial purposes
• You will comply with all applicable laws and regulations

3. License to Use

Subject to your compliance with these Terms, PGI grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use ExpireMe™ on your personal mobile device for your personal, non-commercial use.

This license does not include the right to:

• Copy, modify, or create derivative works of the App
• Reverse engineer, decompile, or disassemble the App
• Remove any copyright, trademark, or other proprietary notices
• Rent, lease, lend, sell, or sublicense the App
• Use the App for any commercial purpose

4. User Responsibilities

4.1 Accurate Information

You are responsible for ensuring that all information you enter into the App, including expiration dates, is accurate. The App's image recognition feature is provided as a convenience and may not always be 100% accurate. You should verify all expiration dates, especially for critical items like prescriptions and food products.

4.2 Security

You are responsible for maintaining the security of your device and any authentication methods (Face ID, Touch ID, passcode) used to access the App. You should not share your device passcode or allow unauthorized access to your device.

4.3 Prohibited Uses

You agree not to:

• Use the App for any illegal purpose or in violation of any laws
• Attempt to gain unauthorized access to the App or its systems
• Interfere with or disrupt the App's functionality
• Use automated systems or bots to access the App
• Share or distribute the App or any part of it
• Use the App to store or process data for others without authorization

5. Data and Privacy

All data you enter into ExpireMe™ is stored locally on your device. We do not collect, transmit, or store your expiration items, photos, or sensitive information on our servers. Your use of the App is also governed by our Privacy Policy, which can be found at /expireme/privacy-policy. By using the App, you consent to the collection and use of information as described in the Privacy Policy.

6. Disclaimers and Limitations

6.1 No Medical or Legal Advice

ExpireMe™ is a tracking tool and does not provide medical, legal, or professional advice. The App is not a substitute for professional judgment. For prescriptions and medications, always verify expiration dates on the actual product and consult with healthcare professionals. For legal documents, licenses, and insurance, consult with appropriate professionals.

6.2 Accuracy Disclaimer

While we strive to provide accurate image recognition and expiration date detection, the App may not always correctly identify expiration dates. You are responsible for verifying all expiration dates, especially for critical items. We are not liable for any consequences resulting from inaccurate expiration date detection or missed expiration dates.

6.3 Availability

The App is provided "as is" and "as available." We do not guarantee that the App will be available at all times, uninterrupted, or error-free. We may modify, suspend, or discontinue the App at any time without notice.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PGI AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, PARTNERS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use or inability to use the App
• Any inaccuracy in expiration date detection or recognition
• Any failure to receive notifications or reminders
• Loss of data due to device failure, deletion, or other causes
• Any unauthorized access to or use of your data

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT YOU PAID TO US, IF ANY, FOR THE APP, OR $50, WHICHEVER IS GREATER.

8. Indemnification

You agree to indemnify, defend, and hold harmless PGI and its affiliates, officers, employees, agents, partners, and licensors from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or relating to your use of the App, violation of these Terms, or violation of any rights of another party.

9. Intellectual Property

The App, including its original content, features, functionality, design, and software, is owned by PGI and is protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

The ExpireMe™ name, logo, and related marks are trademarks of PGI. You may not use these marks without our prior written permission.

10. Updates and Modifications

We may update the App from time to time to add new features, fix bugs, or improve performance. We may also modify these Terms at any time. We will notify you of material changes to these Terms by posting the updated Terms in the App or on our website. Your continued use of the App after such modifications constitutes your acceptance of the updated Terms.

11. Termination

You may stop using the App at any time by deleting it from your device. We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including if you breach these Terms.

Upon termination, your right to use the App will cease immediately. All data stored locally on your device will remain on your device until you delete it or uninstall the App.

12. Third-Party Services

The App may integrate with or use third-party services, including:

• App Stores: Apple App Store, Google Play Store
• Device Operating Systems: iOS, Android
• Location Services: Core Location framework for location-based features
• MapKit Services: Apple's MapKit service for store search and map display. When you search for nearby stores, your location is sent to Apple's MapKit service. Map data, store search results, and addresses are provided by Apple and subject to Apple's terms of service and privacy policy

Your use of these third-party services is subject to their respective terms and conditions and privacy policies. We are not responsible for the practices of third-party services, including the accuracy of map data, store locations, or search results provided by MapKit.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Nevada, United States, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the App shall be resolved in the state and federal courts located in Nevada.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and PGI regarding your use of the App and supersede all prior agreements and understandings.
